Working as a Sub-Contractor for VIVRE CONTRACTORS LTD

Terms and Conditions

These terms and conditions form the agreement for you, the sub-contractor, to work for VIVRE CONTRACTORS LTD:

• A scope of works will be issued to you, the sub-contractor. You should not commence any works until a date has been agreed and a price agreed.
• Only work detailed within the scope should be undertaken as this is the work that has been authorised to be completed. If, at any point it transpires that extra works are required to be undertaken, we will issue you with a revised scope of works. You must not carry out any additional works or make changes to the agreed works without firstly informing VIVRE CONTRACTORS and receiving authorisation.
• Sub-Contractors must not at any time discuss additional work/s price until discussed with VIVRE CONTRACTORS, scope of works or any potential private works directly with a customer. If the customer requires any additional work or wishes to discuss prices or money; you must ask them to discuss such matters with VIVRE CONTRACTORS.
• Sub-Contractors are not permitted to sub-contract any instructed works to a third-party without prior authorisation from VIVRE CONTRACTORS.
• Sub-Contractors are required to provide at your own expense, a guarantee for the work undertaken. If you have sub-contracted any instructed works to a third party, you are also required to provide a guarantee for works undertaken by your appointed sub-contractor. Guarantee duration to be discussed
• Any customer data that is held by the Sub-contractor, must only be used for the purposes intended and be destroyed after a 12-month period.

Payment Terms

• Please issue VIVRE CONTRACTORS with an invoice(for the LTD) every one week in arrears against the ongoing works. Your invoice should be for no more than the amount agreed prior to commencement of works and for one week.
• Payment terms are 2 weeks deposite,and weekly payment,just if different agree and confirmed.
• You must be registered for CIS if the works that your company undertakes are liable for CIS deductions. You are required to provide VIVRE CONTRACTORS with your UTR number. Please note that any applicable CIS payments will be deducted on payment of your invoice. Please ensure that your invoice therefore includes a breakdown of materials and labour.
• If you are a Sole Trader, you are responsible for paying your own National Insurance contributions.

Insurance Requirements (For Limited Company)

• You must always carry valid Public Liability insurance and supply a valid and current copy of the certificate to VIVRE CONTRACTORS whenever you renew the policy: -
£5,000,000 is the minimum level of cover required for a Limited Company with two or more Directors - This is our preferred level of cover.
• Company. However, you will be expected to increase your Public Liability Insurance accordingly if instructed to complete reinstatements works where a higher level of cover is required.

Conduct and Appearance

• From a customer perception point of view, Sub-Contractors are acting as representatives of VIVRE CONTRACTORS. When visiting a customer, you must therefore take all appropriate action to ensure that the reputation of VIVRE CONTRACTORS is not tarnished by your actions or the actions of anyone representing you, or instructed by you to perform any agreed works.
• Sub-Contractors must always be dressed appropriately, carry identification, be polite, courteous, and punctual.
• Respect and sensitivity should be shown to all customers, their relatives, friends, and visitors at their property. Sub-contractors must not cause offence, inconvenience or personal harassment to a customer under any circumstances. This includes unkind, embarrassing, and inflammatory or damaging words or gestures.
• Foul, abusive, or threatening language or behaviour will not be tolerated.
• If for any reason you are unable to attend site at the time and date agreed, you must contact VIVRE CONTRACTORS who will look to liaise with the customer to rearrange accordingly.
• When attending a customer’s property, you must not smoke, consume alcohol, or take drugs under any circumstances.

Health and Safety

• Prior to commencement of works, you must be acquainted with all Acts and Regulations relevant to the work being undertaken and agree throughout the duration of the works to comply with them, for example:
o The Health and Safety at Work Act 1974
o The Construction (Design and Management) Regulations 2015
o The Manual Handling Operations Regulations 1992
o The Provision and Use of Work Equipment Regulations 1998
o The Work at Height Regulations 2005
• All tools, plant or equipment provided by you must be suitable for their purpose and used safely.
• Any equipment much be detached from its power source when not in use and stored safely.
• If you are carrying out works in an unoccupied property, materials and tools can be left in the property at your own risk. If you are carrying out works in an occupied property, you must ask the customer if materials and tools can be stored in a particular place, checking that they will not cause any inconvenience or safety concerns. Again, these will be left at your own risk.
• You must always take necessary precautions to keep floor areas and contents e.g. furniture protected by using dust sheets or plastic floor protection sheets, therefore preventing damage to a customer’s property, contents and belongings.
• All debris must be removed from site on completion of the works leaving the work area clean and tidy.
